1. About these Terms
These Terms of Service ("Terms") govern your use of the TestHero website and application ("Service"), operated by Letts Learn Pty Ltd (trading as TestHero) ("we", "us", "our"). By accessing or using the Service, you agree to these Terms.
If you create or manage an account for a child, you confirm you are the child's parent or legal guardian, or otherwise authorised to act on their behalf.
2. Eligibility and Accounts
You must be at least 18 years old and legally able to enter into a contract to purchase and manage a TestHero account.
You are responsible for keeping your login details secure and for activity on your account. If you suspect unauthorised access, contact us promptly at support@testhero.com.au.
3. Plan, Pricing, and Payment
Unless stated otherwise at checkout, TestHero is offered as a one-time payment for lifetime access to the purchased family plan features (currently up to three child profiles).
- All prices are shown in Australian dollars (AUD).
- Payments are processed securely by Stripe.
- No recurring subscription fees apply unless we clearly present and you expressly accept a recurring plan in future.
We may change pricing for future purchases, but this will not change the core access already purchased under your existing plan.
4. Money-Back Guarantee
Our public offer is: if your child does not achieve a "Strong" or "Exceeding" NAPLAN result in either Writing or Spelling after using TestHero, you may request a full refund of the purchase price. No minimum practice is required.
To process a refund, we may ask for reasonable evidence (for example, the official NAPLAN result) and basic account details to verify the request.
This guarantee is provided in addition to, and does not limit, your rights under Australian Consumer Law.
5. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any rights or remedies you have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law (ACL).
If our service has a major failure, you are entitled to available ACL remedies, which may include cancellation, refund, compensation, or other statutory remedies. If the failure is not major, you are entitled to have the issue fixed within a reasonable time, and if it is not fixed, you may be entitled to further ACL remedies.
6. Acceptable Use
You must use the Service lawfully and only for personal educational purposes. You must not:
- Use the Service for unlawful, abusive, or fraudulent activity.
- Attempt to interfere with security, bypass access controls, or disrupt the Service.
- Copy, scrape, reverse engineer, or commercially exploit the Service or its content, except as permitted by law.
- Share account access in a way that circumvents plan limits.
7. Intellectual Property
All platform content, software, and branding are owned by or licensed to TestHero. We grant you a limited, non-exclusive, non-transferable licence to use the Service for your household's educational use while your account is active.
Student work submitted through the Service remains owned by the student and/or their parent or guardian. You grant us a limited licence to process that content to provide feedback and core product functionality.
8. AI-Generated Feedback
TestHero uses automated systems, including AI, to generate educational feedback. This feedback is intended as a learning aid and should not be treated as the only measure of your child's capability or progress.
9. Service Availability and Changes
We work to keep the Service available and secure, but uninterrupted or error-free access cannot be guaranteed.
We may improve, modify, or retire features over time. If a material change significantly reduces paid core functionality, we will provide an appropriate remedy consistent with ACL requirements.
10. Suspension or Termination
We may suspend or terminate access if there is a serious breach of these Terms, security misuse, or unlawful conduct. Where reasonably practicable, we will provide notice and an opportunity to remedy before termination.
You may stop using the Service at any time and request account closure by contacting support@testhero.com.au.
11. Liability
Subject to non-excludable rights under Australian law, we are not liable for indirect or consequential losses arising from use of the Service.
Where permitted by law, our liability for non-major failures is limited to supplying the services again or paying the cost of having the services supplied again. This clause does not limit rights that cannot be limited under the ACL.
12. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect personal information under Australian privacy law.
13. Changes to these Terms
We may update these Terms from time to time. If changes are material, we will provide notice (for example, by email or in-product notice) before the changes take effect. The "Last updated" date reflects the latest revision date.
14. Governing Law
These Terms are governed by the laws of Queensland, Australia. Disputes may be brought in courts with competent jurisdiction, including courts in Queensland. This does not limit any right you may have to rely on mandatory consumer protections in your home jurisdiction within Australia.
